Terms of Service

1. Acceptance of Terms

By accessing or using the Forbono platform ("Service"), operated by Flavor d.o.o. ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Forbono is a software-as-a-service (SaaS) platform that provides personal service providers (hair salons, barbers, beauty studios, spas, and similar businesses) with professionally designed websites featuring integrated online appointment booking, automated client reminders, client management tools, and business analytics.

3. Account Registration

To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use of your account

You must be at least 18 years of age to create an account. By registering, you represent that you have the legal capacity to enter into a binding agreement.

4. Subscription Plans and Payment

The Service is offered through subscription plans (Basic, Pro, and Pro Plus) with the pricing displayed on our website. All prices are in Euros and exclude applicable taxes unless stated otherwise.

• Billing cycle: Subscriptions are billed monthly in advance.
• Free trial: If a free trial is offered, you will not be charged until the trial period ends. You may cancel at any time during the trial.
• Payment methods: We accept major credit cards and other payment methods as displayed during checkout.
• Failed payments: If a payment fails, we will attempt to process it again. If payment remains unsuccessful after 7 days, your account may be suspended.
• Price changes: We may change subscription pricing with at least 30 days' written notice. Price changes take effect at the start of your next billing cycle.

5. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• No partial refunds are provided for unused portions of a billing period
• You may export your data before the subscription ends
• After the subscription ends, your website will be taken offline and your data will be retained for 30 days before permanent deletion

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Distribute malware, spam, or harmful content
• Attempt to gain unauthorised access to the Service or its infrastructure
• Use the Service for any purpose other than operating a legitimate personal service business
• Upload or display content that is defamatory, obscene, or otherwise objectionable
• Interfere with or disrupt the integrity or performance of the Service

We reserve the right to suspend or terminate accounts that violate these terms without notice.

7. Intellectual Property

The Service, including its design, software, templates, logos, and documentation, is the intellectual property of Flavor d.o.o. and is protected by copyright and other intellectual property laws.

You retain ownership of all content you upload to the Service (text, images, business information). By uploading content, you grant us a limited licence to host, display, and transmit that content solely for the purpose of providing the Service.

Website templates provided by the Service are licensed for use within the platform only and may not be extracted, copied, or used outside of Forbono.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data and the data of your clients.

You are responsible for ensuring that your use of the Service complies with applicable data protection laws (including GDPR) in relation to the personal data of your clients that you process through the Service.

9. Service Availability and Support

We aim to provide 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance where possible.

Technical support is available via email. Response times vary by subscription plan.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind, whether express or implied
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability arising from your use of the Service shall not exceed the total amount paid by you in the 12 months preceding the claim
• We are not liable for any loss of data, revenue, or business opportunities

11. Indemnification

You agree to indemnify and hold harmless Flavor d.o.o., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may terminate or suspend your account immediately, without prior notice, if:

• You breach any provision of these Terms
• Your payment is overdue for more than 30 days
• We are required to do so by law
• We cease to offer the Service (with at least 90 days' notice)

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Croatia. Any disputes arising from these Terms shall be resolved by the competent courts in Zagreb, Croatia.

Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.
